The lines affecting the north Palo Duro Canyon have now been assigned to a new docket at the Public Utility Commission, Docket 38290.   Sharyland filed their CCN  application on June 16th and, to our dismay, Sharyland designated 5 of 12 alternative routes across the north Palo Duro Canyon.   According to the SOAH judge presiding over the case, any one of the 12 alternative routes, or any combination of properly noticed routes, may be chosen.  Now is the time to make your opinions heard!

If you are a party with a justiciable interest in the proceedings and you would like to intervene to make your comments and concerns of record in the case, you must intervene by July 16th

If you do not wish to intervene but would like to comment only, you can make public comments to the Public Utility Commission of Texas opposing the proposed lines that cross the north Palo Duro Canyon by sending a protest letter, along with ten copies, to:

Public Utility Commission of Texas
Central Records
Attn: Filing Clerk
1701 N. Congress Ave.
P.O. Box 13326
Austin, TX 78711-3326

As noted on the PUCT's Protest Letter form, public protest letters do not make you a party to the case, are not considered evidence in the case, and do not obligate you to have any further participation in the proceedings.   According to the PUCT, protest letters do help inform the PUCT and its staff of the public concerns and issues surrounding the transmission lines and routes.

In the protest letter, please include the following information:

  1. A reference to the two proposed routes for the 345kV transmission line that cross the Palo Duro Canyon north of the Palo Duro Canyon State Park in Randall County, near or along Link AA and Link V;
  2. Your concerns and objections to these two proposed routes;
  3. A request that your public comments be filed under Docket No. 38290;
  4. A request that the lines crossing the canyon be dropped from consideration;  and
  5. Please fill out and attach PUCT’s Protest FormProtest Form.

If you would like to address your letter to individuals, the individuals at the PUCT to address your correpondence to are Barry Smitherman, Chairman, Donna L. Nelson, Commissioner, and Kenneth W.  Anderson, Jr., Commissioner.

It is so important that the Public Utility Commission knows the grave concerns that people have about the proposed lines that cross the north Palo Duro Canyon. The PUCT will not take into consideration any opposition to these lines if we don’t communicate with them.  Everyone, please send in your protest letters!

Thank you for letting your voice be heard and for helping to preserve the beauty of this canyon.
